At Walmart, people tend to feel free to be their quirky selves. Oh, and you can get your stuff pretty cheap there, too. I guess that's all that matters?
Of the stores I've visited, they are consistently understaffed and the employees I do run into… aren't the friendliest bunch. I've heard many people complain, especially on social media outlets, that Walmart brings out the worst in people.
Apparently, this rings true for their employees.
Walmart recently had a 63-year-old worker arrested and charged with felony theft after being accused of stealing a bag of Oreo cookies from the Indiana store while on the clock. One of the most important decisions this employee had to make was… how she was going to eat them.

When Penny Winters was confronted by a Walmart "asset protection manager," she admitted to eating the Oreos. Not only that, she also confessed to stealing other snacks during her seven-month employment with the store.
According to <a href="http://www.thesmokinggun.com/" target="_blank">The Smoking Gun</a>, cops have not estimated the exact value of the cookies Winters ate, but she has been fired from her $11.40 an hour position with the retailer.
Winters was arrested this week after an internal investigation was launched against her when Walmart found an empty package of Oreo cookies in the store. The Portage Police Department also reported that security surveillance showed the shoplifter opening and consuming the goods during her shift.
She was just released on bail.

Ridiculous! How can she be charged with a felony for petty theft? If this story is true, they must have one over zealous prosecutor or something, and as the jails and courthouses overflow and services and education are cut back, people wonder why.

Let me get this strait Max, you believe that local police who respond to a theft at a store are supposed to do nothing when given a tape of a theft because Federal authorities and politicians do a lousy job on crimes in their jurisdictions. Because social injustice is not illegal does not make it right. Something Max doesn’t like? Plundering the elderly and the poor by debasing the currency isn’t something I like either. Employee theft is rife at Walmart, though this remains mostly unreported by the media. People who steal drive up costs to consumers and should be prosecuted. To compensate for the lost profit on one bag of Oreos, Walmart probably has to sell 6 other bags, or even more.
And, these days, corporations make us do all of their background checks and drug screenings yet employee theft is statistically higher than customer theft…. Hmmm… Stop wasting the job seekers time because this is an example of how it costs you money and it still doesn’t work.

Wholesale and what they would sell it for Min. Funny, I have never heard of a “in-state multiple theft” law or whatever it was that you were rambling about. All state vary a little but no state treats a food item the same as all other products. They let stuff go all the time… like when my atm card was used at CVS and they refused to do anything (wasn’t worth their time), and the time my Mom (alzheimers) gave 50K to her neighbor (they said it’s a civil matter – nothing they can do unless she sues her in court). Oh, and the time my dad got his life threatened by a nice young man out on probation (no proof – and witnesses don’t count). I’m telling you, it seems like the local police just can’t be bothered unless of course it’s to satisfy big box management (tax $$$) or to generate income (traffic tickets).

Actually depending on what state you are in it can be considered a felony. Its called the third strike meaning 3 misdemeanor charges if you have a judge that wants to just get it done and over with can in fact charge you with a felony. Even tho the max is usually barely a year in jail and 5 years probation.
If this was in California, if you have ever been convicted of misdemeanor petty theft any future petty thefts are charged as felonies.

Felony theft is anything over 500.00. She confessed to seven months of theft which at 2.50is like 200 packs. I doubt she ate that many which means they left out everything else she stole because Walmart Oreo stealer is a better headline than she stole a TV

She can be charged with felony burglary if they can prove that she entered the premises with the intention of theft. That would include using some sort of device to aid in the theft of goods such as a converted purse, a “booster box”, clothing with extra pockets sewn in, etc.
We do not know all of the circumstances from a short article authored by a person who has an obvious bias against Walmart.

Paul, The appropriate police action would be to give her a citation/fine for petty theft. It will cost the tax payer a lot more money in court appearance, attorney fee, jail, etc. than what was stolen. Walmart should’ve have just fired the worker.
If the Walmart worker admitted to thefts that totaled to a felony amount, she should be charged with a felony. Joe, this probably won’t even make it to court. She’ll most likely cop a plea and it will be over and done with. If Walmart just fired every employee who stole from them, it would be no big deal to get caught.
They cannot charge her with crimes she admitted to doing in times past unless they have evidence of the theft which means they would have to go back through all of their videos to look for specific times she stole these items and personally I don’t believe the cops or walmart are going to set down to days and months of video to catch a cookie thief when they already have her and her crime would be a misdemeanor any way you look at it…people throw words out there and attach it to something they have no clue as to what they are talking about, they would think any theft is a felony b/c they don’t know about the monetary limits of when a crime becomes a felony, say at $500 and over. The felony charge should be against Walmart. They will let the government cover their employees insurance. They try their best not to let any individual work 40 hours per week so they can keep them at part time status. (More money in Walmarts pocket.) The speedy checkout signs should be removed due to false advertising. Of 30 checkouts, I have never seen more than 10 open at a time, it’s usually 3. The only criminal activity is done by Walmart itself. What a shame.

I think Bart has a valid argument that the felony charge was excessive. Walmart has been known to avoid making employees full time for the avoidance of providing a group insurance plan. I personally asked older female workers at various Wal-Mart if it was a decent place to work, and the answer was always “NO” and there was no chance of being made a full-time employee with health benefits especially if you were older. I asked this when I was late 50ish to women about the same age. Wal-Mart’s overzealous prosecution of a felony charge for small amount of food snacks, only proves they are heartless to their employees. The employee probably didn’t get her lunch break when needed, and even if she did, she probably didn’t have enough to afford Oreo cookies. Several reports show that many Wal-Mart employees qualify for food stamps. I think a real deterent to felony crime whould be to force convicted felons to work at Wal-Mart as punishment.

She admitted to stealing one pack of Oreo’s a week at about $4 a pack for 4 years. That’s over $800. In Indiana anything over $500 is a felony.

Gina you are so right, that’s exactly what they do. I use to work there for 15 yrs & when I left I had just got a raise to $11.00. And for 2 yrs I made less than the new hires in the 90′s. Now they’ve hard timed the long timers & got rid of them only to hire part time workers but at Walmart part time is up to 36 hrs a week. To me that’s full time. Sam Walton would roll over in his grave. Yes she was wrong but they are not angels.

She probably shouldn’t of been arrested if it was an under $250 admission like the previous comment stated. That being said, employees only admit to 1/4 of what they steal. Whether or not this is a felony depends upon the laws of your State., in the State in which I live all larceny by employee (embezzlement) arrests are felonies regardless of the value of the stolen product or service. Regardless .. She clearly has no excuse.. Needs to be responsible for her actions and should compensate her employer for their loss..
That makes no sense. I’ve seen shoppers take food off the shelves, open food, eat it themselves or feed their kids, shop around then pay for it when they leave. So how is it an employee is stopped for felony shoplifting but yet a customer is not? Makes no sense.
Well, the customers are paying for it, even though they eat it first… She never paid for them, in 7 months of taking food off the shelves… That is the majoy difference. Tiffany – customer couldn’t be arrested, in most states, until and at least until they show intent to leave without paying. Notice that when you see shoplifting videos on TV, they don’t attempt to stop the person when they conceel the item, but rather at the doors or just beyond the doors. Why? Because simply concealing the item isn’t illegal.
The burden is different when dealing with an employee, where simply taking anything from the company is considered embezellment.

Walmart employees are the most rude and nasty people, I ever dealt with. I ask for help and they all standing in a corner street talking. No one volunteer to help me, too busy with their own, personal issues. Most of this people, don’t do anything, but walk around in circle, killing time. I wish, walmart would be a freindlier place to shop, too many nice people,looking for work, but walmart hired the lazy ones. SMH,
Santana u may be right but I use to work for Walmart & the problem is they got rid of all the older long timers that use to take care of the customers & cared just to hire younger ones who don’t care or lazy ones. When I left they were hard timing us, telling us to stay in our dept (couldn’t show customer where something was anymore), making us clean up several depts & had to go up front to registers to give breaks or lunch but without a increase in pay. I don’t believe that lady made $11.40 unless they have started paying more since I left cause of expecting them to do more work but at my store we were treated real bad & harassed by management. We worked real hard & got treated bad and some of the newer lazy ones got treated better & moved up. We couldn’t understand it. Maybe the rude ones standing around is just some of the few long timers that’s left that’s tired of the bad treatment & decide to stand around & talk to each other & complain to each other & try to figure out what to do about it’s & maybe that’s why they are rude & unhappy. Many of you have good points, suppose there is a federal interstate law, then the law should be followed, or imaging over 7 months she stole / ate over $1000 worth of products/goods, then she needs to pay for that, but sending her to jail on tax payers dime is not the best options. Someone said fire her, that should be a given, another said fine her, I also agree, with that, i.e. make it twice what she stole, or something like that. We can’t just become complacent with theft or any crimes, but punishment should hurt the criminal, not the tax payers, and should fit the crime. Otherwise where do we draw the line, it’s ok to steal $1000, but if it’s $1001, send them to jail, that’s why we have different classifications of crimes,so that’s already done, now we need to enforce them consistently and fairly? We all agree corporate crime should be punished also, but it’s just harder to prove, and harder to get convictions because those people or corporations have LOTS of money to defend themselves! We just have to live with it and take the wins when and where we can.These types of discussion remind me of people who take what ever portions of the Bible fit their needs and preach on them, but disregard the parts they don’t agree with. If you truely believe the bible is the word of God, then follow it, don’t pick and choose the parts you like and disregard the rest. That is main reason I don’t subscribe to any religion, even most of the the priests, fathers, preachers, etc…, don’t adhere to strict adherence only the parts that fit their needs. Sure there are a VERY select few who may follow the bible stictly, but not many, and there is PLENTY of proof frequently in the news proving that point.

I am unhappy to report that more than likely this case will be dismissed. My step-daughter was fired and arrested for embezziling almost $10,000 from a Wal-Mart with 6 others. She has just informed us that the charges were dismissed by Wal-Mart?!?!? How is she ever going to learn anything? She needed this wake up call and spend some time in jail.

*** This is SO ridiculous…seriously…this is why I boycott Walmart…they underpay their employees, overwork them, and I know for a fact that they play favorites with employees and even customers…I shop at my local Walmart and regularly run into the night manager riding around on the motorized vehicle meant to clean the floors…just last week I stopped to say hello to him and told him I was feeling under the weather and he offered me a cookie…from a package of cookies that were featured on an endcap…the brand? OREOS.
If you do not pay a “living Wage”, health care benefits or have snaks for your employees, how do you prosecute them for eating “Stale, out of code date, pull off the shelf and detroy…Cookies” 33 billion in profits and you will ruin someones life for a cookie. Thats WAL-MART.
If you do not agree with Wal-Mart in their prosecution of this employee, then Buy oreo cookies from Target or another retailer and mail them into Wal-Mart Corporate headquartes and tell then to “EAT THIS”. OR just take emptyl packages of Oreos, you and your kids have finished at home, and leave them in the “Sugestion Box” at your local Wal-Mart. (be sure to have the receipt handy so they do not prosecute you.)

I agree. The judge is going to look at them and think they are crazy! She will probably get 1 year probation and will never be able to work or go inside of a walmart ever again. I’m not sure if they should have even called the police but like someone said a “crime” was committed. Felony is just going overboard.

Felony theft is anything over 500.00. She confessed to seven months of theft which at 4.29 is like 116 packs. I doubt she ate that many which means they left out everything else she stole because Walmart Oreo stealer is a better headline than she stole a TV
